Hazardous, degrading and filthy conditions, care and services at the Shalom Adult Home. New York Nursing Home Neglegence Lawsuit
Cunningham v. Ripstein d/b/a/ Shalom Home for Adults [Filed July 1991] New York Lawyers for the Public Interest (NYLPI) brought this action in the Supreme Court of New York on behalf of the plaintiffs seeking damages and other relief to redress a longstanding, continuous pattern of hazardous, degrading and filthy conditions, care and services at Shalom Home for Adults. NYLPI also sought declaratory and injunctive relief, requiring the home to comply with the statutory, regulatory and contractual obligations. Plaintiff Cunningham sued for compensatory and punitive damages arising out of defendant's failure to comply with his statutory, regulatory and contractual obligations. In June of 1992, the Department of Social Services approved a voluntary closure plan for Shalom. The claims for injunctive relief to improve conditions at the home became moot and the claim of the former resident for money damages was settled.
